Changes to the Street Works (Qualification of Operatives and Supervisors) (England) Regulations 2016

 

Section 67 of the New Road and Street Works Act 1991 requires that when street works (specifically the breaking up of the street, or the sewers, drains or tunnels underneath) take place, a trained operative or supervisor must be present at all times.

 Trained operatives and supervisors must be qualified and certificates must be registered in the appropriate Approved Register. The Street Works (Qualification of Operatives and Supervisors) Regulations give details of the qualifications and equivalent European Qualifications that are included. The U.K. qualifications can be found in Regulation 5, and regulation 8 discusses the bodies that are approved to issue the appropriate certificates. It is stated in Regulation 9 that certificates are only valid for 5 years, but can be re-registered.

As long as the trained operative or supervisor has the correct qualifications, there is no restriction applied to a temporary post as stated in Regulation 7.
